As noted in previous correspondence, private streets are the responsibility of the Homeowner’s Association. There is no City Ordinance that sets out maintenance standards for private streets. The City has no authority to require private streets to be repaired or maintained to a certain standard.
The nuisance code (§220.020) prohibits “things kept, maintained, placed or found in or upon any public or private place within the City which is injurious or dangerous to the public health .” We could try to use that provision to get the Meadowbrook homeowners association to repair this street, but that’s a huge stretch that we don’t think will stand up in court.
The street is in bad shape, but it’s not endangering anyone’s health. The best solution we can offer in this case is to send complaints about this street to the homeowners association and demand that they fix it.
