it is 2:44 am. Im now being woken up AGAIN for the umteenth time in recent weeks to a waste industries trash truck servicing brookside market and deli. the dumpster is located off 600 glascock st.
this truck continues to service this business at times ranging between 2 and 5 am weeknights. it is a major annoyance, especially in the middle of the night.
I thought the city of raleigh has an ordinance banning this sort of activity in a residential neighborhood at these times. maybe im mistaken? either way the truck and dumping of the dumpster violate the noise ordinaces for these times involved.
waste industries had no comment and avoided response. yet they continue to operate this way.

I think our best bet is going to be working with the property management company. The owners of the market should be able to get you their information and hopefully be willing to help.

ive asked the market regarding this behavior in the past. Nick..the guy who works the day shift there has basically blown me off saying it wasnt his problem. The owners of the market have been unresponsive.
I can PROVE that waste industries has practiced this behavior before..as complaints regarding them (in many different parts of the city) have been posted many times before on SCF. maybe its time to simply show waste industries that this will not be tolerated, by the city stepping in and FINALLY fining them. I know Waste industries has been warned already in the past..

I will stop by the market tonight and talk to the owners. I agree that pickup past 10pm in this area is too much. The upper units of this building are residential, so it seems a little off to subject residents to a weekly trash collection after midnight.

After speaking with some friends of mine who reside at the paramount building on boylan and johnson st, they say that the SAME TRUCK AND DRIVER is also creating problems over in that area as well too. he services the mcdonalds on peace st around the 4-5am time frames.
Waste Industries Care to Respond to this behavior? YOU KNOW you are violating the city codes, and choose to ignore them anyways.

I'm not saying that it isn't a problem, but I think that for Waste Industries it is pretty standard to pick up in the middle of the night. The problem is that they usually service commercial areas, and when there is mixed use or commercial butting right up against residential, as was the case in the other complaint downtown, there might be some confused expectations on both parts. Hopefully it can get sorted out with some dialogue and understanding. I wouldn't be so quick to villainize them, though; they are just doing what they were hired to do. I fully support strict noise enforcement, and will go to bat for the neighbors if reasonable efforts and dialogue fail.

4:28 AM wednesday morning. truck measured (peak) 85.3 dba on my meter some 75 yards away. dumpster being slammed at 102dba (as loud as a concert at TWC Ampitheater), and the back up beeping was measured at 93.2 dba.
These numbers were measured with a Galaxy Audio CM-160 spl meter. one far more advanced than the RPD uses, and Just as admissible in NC Circuit Courts.
there is no arguement this needs to be addressed.

Also To dispute David T's comment regarding the "weekly" pickup..its more regular than that. sometimes its 2 to 3 times a week and has been as frequent as every weekday.

UPDATE: 615am. Just caught up with truck in the boylan heights area making same racket. just so there is NO questioning as to WHO "owns" this truck..the license plate is:
NC Commercial Plate (white w blue lettering) YA 92409

I am bowing out of this issue. Sounds like Trash Haulin Bandit is all over this one. If you are willing to run around at 4:30 am with a decibel meter chasing garbage trucks, then you don't need any assistance from me. Good luck bro.

I grabbed my meter after i woke up when truck pulled up to service the dumpster at 4:20am wednesday.
I think its just downright disgusting how the COR doesnt even Comment on the issue.
A 911 call will force the city to respond.

911 with a noise complaint will solve this real fast. If it keeps happening, keep calling. They'll get the idea.

Actually, sadly no, calling 911 will not solve it. You will wait for 30 minutes or more at 4am for an officer to respond, then the truck will have left, and you will be told that nothing can be done. Neighbors have fought noise on larger fronts before for many years. It's a joke.

Just spoke to the owners at the market. They are contacting the company that services the dumpster in the morning.

They were also emptying the dumpsters on west morgan area that belong to their service at 4:45am. I have noticed the City has not yet opened this issue. I wonder why?

I wonder if we could get Trash Hauling Bandit to use the meter to check some of the crotich rockets and doctored up motorcycles. While sitting outside at TirNaNog a couple of weeks ago, we had to stop talking each time this guy road his machine by and revved and popped it. What a jerk!

@Guest, If RPD keeps getting called for the same issue, they track it and will start an investigation. Even if they aren't present to observe it, they will figure it out eventually. Will take time but better than nothing.

I plan on blocking the truck's access out of the driveway until officers arrive and can see the violation in action. spl meter in hand. there , an iphone camera on the spot, a citizen complaining , and a violation witnessed by the law.
the truck has a narrow path in and out. he has to back out and avgs 6 mins at this stop.
@jo, these meters arent expensive..they start around $50 for a good one.
I mean seriously, Nick(employee), Bassam (father/owner), and Sam (son of owner) couldnt care less when I asked brookiside mkt about the issue.
Waste Industries IGNORED MY REQUEST..so I emailed them and told them what I am prepared to do , explaining in FULL DETAIL that the law WILL BE CALLED ON THE SPOT. so they cant say they havent been notified as well.

THB et al, also tell the business owner that if he doesn't assist in this, the community will quit giving him business and will start making it hard for him to get other's business. Just do not threaten as then you are in violation of the law.

I have spoken with the supervisor at Waste Industries, he indicated that he has spoken to both of the drivers on this route as well as put a note on the account and this should not occur again. The dumpster is not scheduled to be picked up again until next week, I am closing the issue at this time.

CoR, Can this be looked into from an ordnance perspective instead of a issue perspective? As it seems in many locations all over the city this is being a disruption. This is in direct violation of noise ordnance as many have pointed out. Thanks for getting WM to agree but what about every other place they pick up from at 5am?

We already have a noise ordinance that would address this issue. When we have been made aware of it we have contacted the business owners or the servicers and generally they comply right away.

thank you. as a citizen complaint to waste industries, the response from their corporate office to me, was more or less, "suck it up. not our problem." we knew we needed the city to step up.
