    The bank was cleared of trees -- apparently without permit or notification to neighbors. The property owners were informed on several occasions that shoreline regulations existed that required permitting and that limited the amount of pruning. The attached photos show stumps where large trees were cut to the ground.

    Grow Community Building Owner (@#$% Clark Properties LLC) is taking out ventilation systems in units one by one. Units are without ventilation - suspected code violation. Management company (Windermere Property Management - West Sound in Silverdale) refuses to address the situation. Tenant @ 366 Root Path NW has attempted to remedy with owner and management co and they suggest only to "open a window".

    The Business License and B&O Tax clears states that an Airbnb must be a dwelling or portion of a dwelling, and further defines “dwelling” as a building or portion of a building that provides independent living facilities with provisions for sleeping, eating and sanitation. It goes on to say that RV’s and travel trailers can’t be used. Sweet life farm rents a canvas TIPI for $175 - $194/night and utilizes an outhouse without insulated walls for sanitation facilities. I believe that compost toilets are allowed on the island now, but that would also be of concern that waste and water/septic lines are being handled in a sanitary way. Has Kitsap County allowed composting toilets? Neither of these “structures” are buildings as required by code and do not meet the minimum requirements for running an Airbnb on the island As cute of an idea as it is, either it needs to be closed down, or codes need to be changed to allow similar rental units across the island. Enclosed is a copy of the code and a copy of information off the website, with photos showing both the rental unit and bathrooms.

    Temporary Housing & Vacation Rentals
    Renting all or a portion of a dwelling for commercial purposes is considered doing business on the island requiring the owner(s) to obtain a City Business License. Doing business includes renting a dwelling or portion of a dwelling as temporary or short-term housing or as a vacation rental through such lodging websites as AirBNB.com.

    At this time, the City does not place additional requirements on temporary/short-term housing or vacation rentals with the exception of defining a suitable dwelling for temporary/short-term or vacation occupation. According to Chapter 18.36 of the Municipal Code:

    o A bed and breakfast lodging is not a hotel, motel, inn, home occupation or other use defined or regulated elsewhere in this title, except that bed and breakfast establishments containing one or two sleeping rooms may be considered a minor home occupation as defined and regulated elsewhere in the Municipal Code.
    "Dwelling" or "dwelling unit" means a building or portion of a building that provides independent living facilities with provisions for sleeping, eating and sanitation; provided a recreational vehicle or bus is not a dwelling or dwelling unit.

    Note: RVs and travel trailers are not dwellings and cannot be used as temporary/short-term housing or vacation rentals.

    New viewing platforms have been installed along the trails on the north side of Blakey Harbor. I looked for building permits on the City’s website, but could not find any. I figure since these are public platforms, building permits would be required. I did find a shoreline permit, which I believe is expired - at least 4 years have gone by since it was issued. And within that permit (SSDP15197) it specifies that revised plans must be submitted - were these ever submitted? And that the platforms require grating and to be set farther away from the high water mark. The platforms do not have grating and look like they are right at the water’s edge. And they are made of pressure-treated wood! Not ideal for such an ecologically sensitive area.

    Homeowner is not complying with setback code in rear yard. Several structures have been built next to and beyond lot line to house several animals.I believe the zoning for this property is R-2.9. Furthermore, the manure from these animals is likely flowing into stream behind home which flows into containment ponds behind residence. Number of animals exceeds code as well.
