    Rebuttal to Staff Comment (DC CE - Priscilla): I am reopening this request to contest the claim of "compliance." This property, along with the adjacent property at 1105 N Kadota, is being incorrectly assessed regarding the Public Right of Way (ROW) and surfacing requirements.

    Enforcement Consistency & Contagious Blight: By failing to enforce parking standards at this address and the neighbor's address, Code Enforcement is signaling to the neighborhood that parking on dirt/grass is acceptable. This has created a "cluster" of violations that directly harms the integrity of the Evergreen Historic District.

    Inaccurate ROW Assessment: According to the Pinal County Assessor’s records, the ROW at this location is approximately 3 feet from the curb. The vehicles at 1109 N Kadota are parked significantly deeper into the front yard landscaping than 3 feet. Even a single vehicle width exceeds the ROW; multiple vehicles are clearly on private property.

    Surfacing Violation (CG Code § 17.52.070): The primary violation here is the surface, not just the location. The code requires all parking areas to be asphalt, concrete, or an approved dust-free surface. These vehicles are on raw dirt. Per city code, there is no provision that allows "Right of Way" status to bypass the requirement for improved, dust-free parking surfaces.

    District Standards: As a contributing property in the Historic District, this "dirt-lot" parking style constitutes visual blight under CG Code § 8.12.010.

    Requested Action: Please perform a diligent inspection that accounts for the actual property lines and the mandatory surfacing requirements of § 17.52.070. Code Enforcement must stop using "Right of Way" as an excuse to allow unpaved parking in a Historic District.

    I am reporting a violation regarding significant overgrown weeds and unmanaged vegetation at this corner property. While the mailbox is situated on N Gilbert Ave (bearing the number 915), the lot is situated at the intersection of McMurray and Gilbert. The vegetation is overgrown and creates a state of blight that detracts from the surrounding neighborhood standards.

    Citations:

    CG City Code § 8.08.030 (Weeds, Brush and Rubbish): It is the duty of the owner/occupant to keep the property and the adjacent right-of-way (including sidewalks and half of the alley) free of weeds and rank vegetation.

    IPMC § 302.4 (Weeds): Premises and exterior property shall be maintained free from weeds or plant growth in excess of the established height limit. This property currently exceeds those limits and poses a potential fire and pest hazard.

    Please investigate this location and issue a notice to the owner of record to bring the landscaping into compliance.
