I am a bit confused on a reported problem that is archived but I would like to readdress.

In the ticket, the concern of operating a business out of a residence is addressed. In the commentary, the excessive paving / concrete in the front and side yards is also a concern shared.

"Per the City's Zoning Ordinance, specifically Section 27-766(b)(7) -

Parking shall not be permitted within the front yard in any single-family residential lot, except within a driveway, or in a roofed carport or enclosed garage. Within any single-family residential (R) district not more than thirty-five (35) percent of the total area between the street right-of-way line and the front of the principal building shall be paved, On any lot where adequate width exists so as meet the geometric design standards of the Institute of Traffic Engineers, a circular driveway shall be permitted, subject to the total driveway coverage authorized herein. However, no parking spaces or parking bays shall be established within any such front yard.

To answer the question presented by the concerned citizen - Parking within a front yard of a residential (single-family) property is not permitted on grass/lawns. Additionally, PAVING of the front yard is limited to a maximum of 35 percent. A front yard is defined by the Zoning Ordinance as the "area extending across the total width of a lot between side lot lines and being that area between the street right-of-way lines and that line or lines established by the front wall or walls of the principal structure projected to intersect the side lot lines." Simply put, the front yard is the area defined by the front property line, side lot lines, and the front facade/wall of the residential dwelling."

Is concrete not paving? Is this home not in more then 35% as defined above? Are these not parking spaces as noted?

I understand it looks nice besides massive concrete but what processes does the city have in place now to ensure this does not repeat without city approval if the 35% applies?

In typical Ryland manner, they completed paving in our community, and are trying to pass the buck on to the city of brookhaven for tar-covered roads that they caused. We have a community of 113 homes, and they continue to leave our streets in a condition that is utterly unacceptable.

Rain water is slowing washing away the side of the Childers Rd NE, off of N Druid Hills Rd. This is dangerous because it's creating a drop off and with the curve in the road and overgrown brush on the opposite side of the road, you can't see approaching cars. At a minimum, the brush needs to be cut back. Thank you.

Every time it rains, water accumulates on the street in front of this and the adjacent address and does not drain. Depending on how much rain falls, it will remain for 3 to 6 days.

There are also several large cracks in the street that are likely due to the soil under the road being eroded from underneath by this water.

The newly installed speed humps are too steep and too tall.
The devices are to ensure vehicles do not exceed the posted speed limit -25MPH. The original speed humps that were originally granted (via hearing)and installed by Dekalb Co a few years ago were the proper size.to allow for proper legal ingress and egress. The new speed humps force drivers to slow excessively or be thrown in the air. These steep humps also delay emergency vehicles Emergency Vehicles. I watched an ambulance crawl up the street due to these new incorrect speed humps. This is a street that has NO crosswalkss and homes with sidewalk on just one side_Ogelthorpe fenced grounds are the opposite side.

Directly in front of our house on 3221 Cates Avenue NE Atlanta 30319, there is an entire new can of paint in the road. Not sure if it was done deliberately or if it fell off a truck. It could become a bigger mess than what it is if it isn't immediately clean up (still wet).

Patch breaking up. About 12" x 12" and 5" deep

Two pot holes on N Thompson right near 2610. One with cones and the other in front of the driveway 2610 that collects and continues to hold water until we have days of sunshine. I have made the city aware of both several times.

a pothole has been created around the water sewer plate that is located 10 ft from the end of a resident driveway. very small children walk directly in this area and has potential danger. issue is progressively increasing as service vehicles (i.e.sanitation) travel daily over this sewer plate. hole should be marked immediately with a orange cone until pavement repair can be completed.

Large, deep depression (more of a sinkhole than pothole), located smack dab in the middle of Thornwell, between N Druid Hills and Mathews. Hole must be avoided when driving.
