Just curious, what's the penalty / fine?

I'm 10 x more curious to see if the penalty will actually be enforced.

I called the DPW and they told me they are looking into this
it just happened yesterday so i figure i will give it till Monday or Tuesday of next week to check on the progress if any

It would depend on the value of the tree. Since the police did not witness it there would be no action taken. None the less a report should be taken.

If the neighbor witnessed it then why cant the tree choppers be held responsible? I'm not 100% they did see BUT based on this report they did?

Most "criminal acts " aren't witnessed by a police officer.

At this point.....The "if we didn't see it we can't do anything" comment / excuse is nauseating.

Unfortunately, the current penalty per city ordinance for removing a public shade tree is only $300 per offense. In a case such as this, the homeowner is ultimately responsible for what happens on their property, not the person performing the work. I, as the City Arborist, will be issuing a citation for the removal of two public shade trees in this instance. Thank you for bringing this to our attention.

Thank you Scott. I was told by someone in city hall that it was criminal as it was damage to city property but your ability to cite is surely more effective than the courts. Thanks again.
