Description
The new owner of this residential lot, zoned R-1D in the SE Heights Neighborhood Association has no plans to build a home on the site anytime soon, AND plans to use the vacant lot for a "dog agility training class" that the owner is involved with. This is not a commercial property. They have also connected city water and sewer line to their shed and have a toilet installed inside of this shed, so since when are you allowed to have a portable building with a toilet and no other residentialk structure on site. Storage sheds and portable buildings like this are only allowed when they are in the yard of a residence, not when they are erected without a residence. On top of that, this is not a commercial district and the neighborhood strongly opposes whatever dog agility program they intend to operate there.

I asked a worker what was going there when I was walking by there the other day. Actually I asked where the house was going to go with the tool shed in the middle of the lot the way that it is. He said "that's it, no house." I asked what he meant by that. He said that the owner isn't planning to build a home there for now, or not anytime soon, and is installing a metal carport between the shed and the sidewalk, where he will park his RV or extra vehicles. And, went on to tell me about some dog agility facility that the owner will operate there. I didn't get into it any further since the guy was just there working and not the one making the decisions.
That said, the neighborhood and city planning and zoning dept should be outraged and someone needs to put an end to this before it gets too far. If you want to operate a business, buy land that is zoned for that. I love animals too, but that doesn't mean I want to live by an animal training facility, or to have to put up with non residential traffic, extra cars on the street, and noise that goes along with something like that. Nor did the other neighbors, especially those directly impacted by whoever the inconsiderate person is that bought this property. The tool shed, even if it's got plumbing inside of it, needs to go. It's a clear violation of the zoning codes because there is not a residence constructed on the property, and in order to have a shed, you must have a house that is occupied (Per City of ABQ). The shed cannot be classified as a residence. It was manufactured offsite. It is not large enough. Does not have a kitchen, or square footage large enough to be considered a single family residence. Parkland Hills (Unit 1) where the property is located has R-1D zoning, as the lot is more than 10,000 square feet. There are setback requirements, height restrictions, and this is a corner lot, which may have additional setbacks or restrictions. If what the other neighbors report is true, it is also not acceptable to have a sewer line connected to city services that is essentially the drain for an outhouse, which is what a shed with a toilet inside of it would be considered. The fact that the city permitted plumbing work for this type of building or addition to the property (I dont even know what you call this mess) is deeply concerning and fairly alarming.
It doesn't take a rocket scientist to figure out the that the owner of the property clearly has no plans to build a residential single family home on this property anytime soon. If they did, they would not be placing an offsite built shed in the center of the property with a sewer line that connects to city services, that runs directly to that shed, where there is supposedly a toilet installed. Furthermore, there would not be a driveway leading to the center of the back side of the property, nor would they be preparing to construct a metal carport that attaches to that concrete driveway and prefab shed. And what do they need the massive black iron gates, that look like they belong at Elvis's Graceland Mansion, not securing a portable outhouse and some dog training equipment? When walking by the property again today, I noticed the curb cutouts that were complete. I'm assuming a permit was properly obtained, and if so, I want to know how it's possible for these projects to be approved on this residential lot that happens to sit within the historic district overlay that we recently received?
I will not stand for this. To blatantly disrespect the building codes and zoning laws of the city, to show no regard for any of the neighbors, and to think that the rules don't apply to you and you can do whatever you want and ask for forgiveness later tells me plenty about the owner. Maybe it's for the better that they don't build on the lot right now because I can only imagine what monstrosity they'd have built there. Who knows, maybe they'll upgrade the Tuff Shed to a doublewide and try to sneak that past city inspectors too.
If the new owner of the lot used a real estate broker to purchase the lot, they should be penalized if they knew he had no intentions of using the property as it was intended to be used. I strongly oppose the activity going on there and I think many of my neighbors will agree. Please take action now.
