Description
All of the lights along the entire back area of the Rio Vista Apartments are out. These lights are posted in the field which is marked as GOVERNMENT PROPERTY. Not sure who is responsible for fixing this, but it is up to the city to ENFORCE and to serve as liaison to other public entities to get things on government property fixed. This is the same area where large groups of male dayworkers hang out getting drunk. It is also where cars, trucks, four wheelers, etc. drive into field to do/buy/exchange drugs and who knows what else. It is pitch black dark back there now and is presenting an even more significant public safety risk!

having the lights back does help and nice of someone to get them fixed, but this place needs more than just fixed light and an occasional drive through from police, it needs further investigation regarding business and leasing practices, violations regarding fair housing (discrimination and quality of living here-Title VIII of the Civil Rights Act of 1968 Fair Housing Act), public health (men allowed to urinate outside, wherever-Texas Health & Safety Code - Section 121.003. Powers Of Municipalities And Counties), utility/sewage strain due to too many adults living in units (we have water and electrical issues weekly), check Texas state maximum occupancy guidelines/regulations-Texas Property Code - Section 92.010. Occupancy Limits,

§ 2.104. [Landlord to Maintain Premises]
(a) A landlord shall
(1) comply with the requirements of applicable building and housing codes materially affecting health and safety;
(2) make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition;
(3) keep all common areas of the premises in a clean and safe condition;
(4) maintain in good and safe working order and condition all electrical, plumbing, sanitary, heating, ventilating, air-conditioning, and other facilities and appliances, including elevators, supplied or required to be supplied by him;
(5) provide and maintain appropriate receptacles and conveniences for the removal of ashes, garbage, rubbish, and other waste incidental to the occupancy of the dwelling unit and arrange for their removal; and
(6) supply running water and reasonable amounts of hot water at all times and reasonable heat [between [October 1] and [May 1]] except where the building that includes the dwelling unit is not required by law to be equipped for that purpose, or the dwelling unit is so constructed that heat or hot water is generated by an installation within the exclusive control of the tenant and supplied by a direct public utility connection.

Sec. 1-5. - General penalty; continuous violations.
No person shall violate any of the provisions of the ordinances of the city. Any person, firm or corporation who violates, disobeys, omits, neglects, refuses to comply with, or resists the enforcement of any of the provisions of this Code, or any ordinances of the City of Haltom City, which govern fire safety, zoning or public health and sanitation, including dumping of refuse, shall be fined not more than $2,000.00 for each offense and shall be fined not more than $500.00 for violations of all other provisions of this Code or other ordinances of the City of Haltom City. Each day that a violation is permitted to exist shall constitute a separate offense. Nothing herein shall affect any minimum fine prescribed by any ordinance of the City of Haltom City and any such minimum fine shall remain unchanged.

Sec. 2-321. - Definitions.
For the purposes of this article:
Enforcement order shall mean a written order issued by a magistrate authorizing entry by the city onto specified premises for the purpose of abating a nuisance or other condition which is in violation of city ordinance or state statute.
Inspector shall mean any official inspector for any department of the city who is charged with the enforcement of city ordinances, including, but not limited to, inspectors for the departments of zoning, environmental control, housing, building inspection, fire inspection and health inspection.
Magistrate shall mean the judge of the municipal court of the city, or any other person or position designated as a magistrate by state law.
Search warrant shall mean a written order issued by a magistrate and directed to any inspector or peace officer commanding him to a specified premises to determine the presence of a violation of any ordinance of the city.

Sec. 2-322. - Conflicts; additional remedies.
(a)
Nothing contained in this article shall be construed to conflict with any state or federal law and shall be in addition to any rights granted thereby. The city or any inspector or peace officer may seek other available enforcement remedies, both civil and criminal, in addition to those allowed by this article.
(b)
Nothing in this article shall be construed to prevent the city or any inspector from performing inspections or abatement work without the necessity of a warrant or order where authorized by law.

The chief of police and all police officers have the powers, rights, and jurisdiction as prescribed by state law. It shall be their duty to prevent the commission of offenses against the laws of the state and against the ordinances and regulations of the city; to obey, observe, and enforce all such laws, ordinances, and regulations; to detect and arrest offenders of all such laws, ordinances, and regulations; to preserve the good order of the city; and to secure the inhabitants of the city form violence, injury, and property damage.
