Description

A house (624-28 Bainbridge) that already has 4 interior parking spaces built an addition (622 Bainbridge) and added a fifth. The Streets Department granted a curb cut, but #622 was never re-zoned to authorize the changed use. The owner has pursued his curb cut despite clearly articulated neighborhood opposition and the reality of the need for public parking so close to South Street. It is a case of public good versus private entitlement. When the property owner tried to get the curb cut in 2009, it was stopped and neighbors unanimously petitioned Councilman DiCicco to have a public hearing. That never happened, nor has there been a zoning hearing or notice. We have petitioned again, this time with more anger on our block than even before.

This not only affects those of us who live on the same block, but anyone who needs a parking space whether friends or customers of the many stores around the area. We trust that common sense --and less greediness from the owners at 622-628-- will grant us the positive results we seek: to get back the public space they took; after all they already have four spaces and could easily allow those who visit them park in one of their two private garages...

Unfortunately, not yet. The property owner received a permit for a curb cut from the Streets Department. This shouldn't have happened, but the owner has disguised the fact that #622 is an addition to 624-28. As an addition, and already having 4 curb cuts, there is no way the fifth one (at 622) would have been granted. L&I is hopefully pursuing a complete investigation and meanwhile neighbors are investigating other options.

What is the latest with this issue? The owners seem to have hardened in their stance on the issue as well as in their contempt for their neighbors. What legal steps can be taken next? Can we take up a collection to hire an attorney to get back this parking space?

I haven't gotten anywhere with L&I. I talked to the inspector once and e-mailed him as a follow up. He told me that if I proved to him that there was an interior breech between the 2 buildings then they could do an actual inspection. Nothing happened, when I sent him that proof.

DiCicco didn't do anything at all.

I was encouraged to pursue an attorney, but the attorney didn't seem too capable and then he flaked

Will it help to try with Squilla?

I got too busy to deal with this but I'm still interested in pursuing it. I'd be up to renewing the effort--

How did you get proof that there is an interior breach? Also, what is the name of the L&I inspector? I think it's worth dusting this off for Squilla and his people. Of course, he's an attorney, just like the property owner. There is honor among thieves.

It was confirmed to me by someone who has been inside the house. There is a doorway from the house to the pool.
