We are aware that this property had a furnace break down and a new furnace is set to be installed. The property owners applied to the Department of Public Works on December 11th for a permit to install the new steam boiler.
The temporary heating device outside is producing warm air and venting into the existing ducts for the residents until the new system is functional.
The State Statute for noise disturbances is based on a reasonableness standard. Under these circumstances it is our opinion that the noise is not a violation.
The Burlington Police Department is responsible for enforcing the State Statute and the city ordinance, Chapter 21-13 which is below for your reference.
