  On 11/06/2023 SCHWEIER was able to conduct follow up at the listed location while the garage door was open. SCHWEIER was able to observe and photograph multiple cars inside the garage which were in various states of repair.
  SCHWEIER photographed the violation. The photos are attached to the case file.
  SCHWEIER spoke with the only person present who identified himself as Beni, but real name of Omar. OMAR was advised tha5 the business was operating improperly because it did not receive approval from Planning Commission. OMAR was advised that work could not continue until the business was approved.
  SCHWEIER later received a call from 513-658-9209 who was asking about the PC. SCHWEIER referred them to the website and also advised that if they emailed SCHWEIER he would return information via email.

  On 11.06/2023 SCHWEIER conducted an open source check of the Butler County Auditors office website to determine the listed owner of the property.

  On 11/07/2023 SCJHWEIER contacted the property owner, Gerald Saurber (SAURBER) in regards to the violation. SCHWEIER advised that automotive uses were required to receive Planning Commission approval and that the business must cease until the approval is received.
  SCHWEIER emailed SAURBER the Conditional Use application. SCHWEIER advised SAURBER that a Violation letter was going to be issued.

  Just wanted to inform you all that operating has never ceased. Still all hours of the day. You’re going to have to be a bit more stern with these guys. We do not want such a business in this neighborhood and if necessary we are going to get the state involved as well as the epa. I’m sure the owner of the building doesn’t want this headache so it’s best he evicts them. We will be watching closely for the city to act.

  They were given an opportunity to submit a Conditional Use application. That time has expired and second violation letters are going to be sent this week. Building Department has also been brought into the conversation.

  The Director of Building, RIVERA, spoke with the owner on Friday. RIVERA advised that the owner was going to call in regards to the Conditional Use Application.

  We the Neighbors are trying to wrap our head around this situation and it’s almost becoming comical. Here we are “4” months later after the first report. Nothing has changed. There were junk cars sitting outside today from a salvage auction. You guys don’t get it. They are still working in this space 7 days a week. Is this really how the city addresses zoning issues lol. Especially ones that violate several epa concerns on top of it? Give the building owner a 30 day notice for them to vacate and find another place to junk up, we are over it literally! We can loop the mayor in on this neglected situation. Let’s see a little pace picked up here. Time has elapsed enough. It’s not zoned for this, it’s time for them to go!

  On 01/10/2023 SCHWEIER posted the second Notice of Violation letter and mailed the second NOV letter to the business owner and property owner.

  SCHWEIER and WILSON met with the building owner and an architect to discuss a Conditional Use Application. Based upon the discussions and an application being worked on, SCHWEIER will halt follow ups until March 1. If an application is received, SCHWEIER will wait until the Planning Commission decides on the application.

  Can you please explain to the neighbors of this business why this subject hasn’t been resolved as of yet. This building isn’t zoned for automotive repair and surely isn’t for autobody repairs & paint with no paint booth to top it off. They are junking up our neighborhood, working on cars at all hours with lots of people etc. This business has never stopped operating at all!!!!!!! We are sick of it!!! What does the zoning office not get? Really??? It’s been 5 months now! This is an absolute joke!

  The City has an enforcement process which is being followed. The city also has a process for the business to apply for and receive permission to operate. We are currently working through both processes. When we met with the owner of the building he advised that his knowledge, they were not working in the building. If they are, I will forward that information on.
  There is no paint boot in the building. If you have evidence that they are painting, please let me know that.
  You will be notified of any plan requesting permission to use that building as a legal auto repair. I would encourage you to attend that meeting and provide input.
  I will continue to work through our process to get the business halted, but we have limited authority.

  Aj just wanted to add work is still continuing. There a guy named Kenny from iGlass of fairfield there now installing a windshield in a wrecked car. Still no change their work hasn’t stopped.
