"When this was checked on 04/10/2024, it was determined these do not meet the criteria of an Abandoned Vehicle."

100% meets the criteria for being abandoned under 8-5-2-3 (A)(2) and has shown a lack of movement. The burden of proof is on the owner that the vehicle has moved more than .2 of a mile (1056'). Vehicle does not have a valid police sticker. https://seeclickfix.com/issues/16360085

8-5-2-3 ABANDONED AND INOPERABLE VEHICLES.
(A) A vehicle is abandoned if:
(1) The vehicle is parked on or along any street, alley or public way and the vehicle displays no current license plate and validating sticker; or
(2) The vehicle is left unattended on or along any public property, street, alley or public way in the same place for a period of 36 hours without a valid police sticker as defined in division (B) of this section;

8-1-3-16 BURDEN OF PROOF; EXCEPTIONS BY DEFENSE.
In all prosecutions under this Traffic Code in which the defense is based on an exception or exemption, the burden shall be on the defendant to present sufficient evidence to raise a reasonable doubt as to such defense, and then the burden shall shift to the prosecution to prove the absence of the exception or exemption just as any other element of the offense.
