Description

In April 2008 a soft blockage in the main line on Wedgewood Dr. caused sewage to back up into our finished basement. The City of Torrington admitted their fault immediately and paid a cleaning company to come in and clean up for one whole week. Almost two years later we are still waiting for the town to settle with us for something more than $8,000.00 dollars. Estimates we have retained in the last 2 years have ranged from $22,000.00-$71,000.00. These estimates are for restoring our 3 rooms in the basement to their previous condition and not even looking at our losses of furniture and possessions from contaminated water. At present the City of Torrington's insurance company is pressuring us to sign a release for $8,000.00 which we haven't and Mayor Bingham is trying to say he can't get involved because the city's insurance co. and our lawyer AGREED on a settlement. This is not possible as only the property owners(my husband and I) could have signed a release on this, and we haven't. Two years without my downstairs, still paying taxes, and no help from the town.

how can torrington justify letting this terrible incident continue??? don't they have insurance to cover their accidents such as this??? come on mayor....take action and fix this problem that the city created....NOW

We all understand that our homes are sometimes subjected to maintenance problems for which we are responsible. However, when the problem is caused by a blockage in a main sewer line, the Town has a responsibility to make good on the damage. Why do we pay taxes that cover the cost of insurance? Is Torrington not carrying the necessary insurance to protect not only the city but also the taxpayers against unexpected damage? To believe that insurance would pay only a portion of such extensive damage suggests that Torrington is not properly insured. It sounds as though this is a bigger issue than paying for the damage that was done. Come on, Mayor. If the city is properly insured, let's pay up!

I want to see this problem fixed as well. Being a past resident of Wedgewood dr. I have heard many stories in the past of sewage back ups as soon as the Middle School was built. The system is way over used and of course it will back up. Look at all of the new home sites there now compared to when Tempkin developed this area. These people happen to live at the bottom of the hill and we all know water runs down and not up. The City has appropriate insurance to take care of this poor family. A sewage back up is very unhealthy to say the least. They own a home and have lost full useage. Cut the taxes until repaired and pay them what is necessary. I see the Golden Palace (City Hall ) is coming along well.
Lets consider the folks that are paying for your luxury! My feelings are that you should stay at the Torrington Co site. Very user friendly. I have enjoyed my visits there much more than Main St. The workers seem really user friendly and I would like to thank all of them for that.

It costs $35.00 to file a claim in small claims court.
They will get served a notice to appear.
They will have to respond then, in court.
They will resolve before then.

Hey Mayor Bingham: I think you had better pay attention to your constituents problems especially when the orginal problem is due to a city problem. To be told that the city would cover it, in a letter, and then to renege on the deal... Hmmmm doesn't say much about the integrity of the City of Torrington. I can't believe that the City would expect $8,000 would cover the cost . That offer might have been acceptable 30+ years ago!!!

This is very sad that nothing has been solved yet. Sewage backup is unhealty. If this couple haven't signed a release how can the attorneys decide the fate of the matter. This really makes no sense, it has been to long.

Torrington admitted blame when they sent in a cleaning crew. And now they only want to pay minimally, about a third of the cost to fix the basement? What a slap in the face! Seems to me that they're stalling and hoping that you'll get fed up, give up, and pay for the repairs yourself. Stand firm. The longer they wait, over time the cost to make the repairs (labor & materials) will increase. If they were smart, they'd settle this case now while there are a lot of unemployed contracters out there looking for work. Good luck.

This is in reference to the sewer problem on wedgewood dr. We are friends of this family and they have endured more than just this sewer problem. With the damage that occured, they have also suffered the loss of many personal items belonging to their son who died eleven years ago. These are things that can not be replaced and it's heart breaking to know what they went through. Their young grand daughter misses things that were her dads, that had to be thrown out due to the contamination of this pipe bursting, etc. Please, have a heart Torrington and bring some peace to them. They may not recover the losses in any way, but at least they can have a clean, decent room to remember their son, his friends, plus the activities that took place in that basement.

I agree with what Susan wrote about the family with the sewer problem and all they have endured over the past couple of years. This family has had more than their share of problems and financial issues which have caused them grief. Give them something positive in their lives by keeping the promises made by the city, the insurance company, etc. But at least be reasonable with the estimates and money given to them. There was/is so much damage done downstairs that it will take thousands to replace walls, furniture, etc.
Put yourself in their shoes and see how much that
basement meant to them with the memories of their
29 year old son and all that they shared with him while he was with them. This is all they would have left to possibly replace a few pictures on walls that need to be reconstructed. Let's not let this go any longer and let's help to ease some of the heartaches.

And the mayor doesn't want to get involved? I am shocked that someone in his position hasn't looked deep enough into this issue! And, by whom was he told that the City's Insurance Company and your lawyer AGREED on a settlement? If this is a false statement, has he since gone back to question his source? Don't sign anything, hire a lawyer...then we'll see how fast the City moves on this issue!

The City of Torrington is responsible for fully restoring everything that was damaged by this issue. That is what insurance is for.

I personally know this family. I knew their son that was lost. The items that were lost in that mess were things that can never be replaced. Many items belonged to their son. These are very wonderful people that would do anything for anyone. Why can't the city and the insurance company be fair. This is the city's fault. Lets get this taken care of for them. Enough waiting.

Mayor Bingham, I believe that this is somthing that you can help with. You pay not be able to write the check, but you can at least be on the citizen's side, not the insurance company's side. This homeowner should be paid for the damages, and the if what Tim Grieco says is true, the sewer system needs to be anylized, and upgraded in this area to handle the current sewage flow and prevent any further problems. This house is right at the bottom of the hill, and has the it's basement is at the lowest elevation, and is the first and probably the only house that will ever have a this problem on the street. I think the homeowner should contact the local news stations if this problem does not get resolved soon. Two years is enough time to finish this.

I have an awesome insurance agent -- She told me that since I live at the bottom of a cul-de-sac, I need a "rider" that will cover those expenses in the event that the city won't cover all of my loss. The "rider" cost me $40 extra per year. Well worth the money folks! If you are connected to city sewer services, check your homeowners policy to see if you are covered...

This situation with is not only unhealthy, but hazardous as well. Raw Sewage contains methane gas. I'm surprised State Dept. of Public Health Dept. isn't involved in this too!

Tell your lawyer it is time for action. If you can't get satisfaction from him, get a new lawyer. See about getting a one way valve on your sewer line to prevent this from happening again. Good luck.
Mayor Bingham, Get off the pot and get this resolved. There is no need for this taking this long. If this goes to court it will cost the city more money.

Please help this family. They are good people who have suffered the loss of their only son. They should not have to also suffer the loss of their downstairs at no fault of their own. It is unacceptable that two years later this matter remains unsettled.

I have known the family for almost 20 years, and after paying taxes for more than that I feel that the city more than owes this to them, especially since a portion of this lost possessions belonged to their late son, a wonderful man. Please keep this thread going for them.

I would say it's time for a Lawyer. I'm sure we all agree. What we need is a Pro Bono offer for my friends and ex neighbors. Each Legal firm has to do this as a Community service. I can suggest who NOT to hire from past experience. We will keep this thread going for the MAXWELLS.

Get a lawyer. long overdue. what about some of those
who advertise on TV No results no pay. but be sure
all the residents have the town re-valuate their property
to show the damage to their full basements and the
what is not usable as non usable living space. They should make sure the town assessor does not tax them for space which does not meet living space standards. get it in writing. Have a private assessor build a case against the tax bill if they do not lower the assessment accordingly
Contact the Hartford Courant tom shay to point out the
towns reaction to a situation they do not make good on.

Please get this fixed, as soon as possible. They are Torrington's Taxpayer, and help pay your salaries as well. How could you let this go for 2 years? Someone in Authority should be fired? But it's hard to fire an elected official, only if you get enough signatures to cast them out! I say this, if there were any descrepancies in this matter, which already deems that there might have been.
Again, to the Maxwell's don't sign anything, or pay in full for anything, until, all the work is done!

CM, Perhaps this problem already existed, before the house was built there. Well if the engineers knew there would be a problem and still built the house on a chance, oh well,............. . This is not the time to point fingers. you can do that later. The Bottom Line is, this needs to be fixed now.

Please help this family get this problem resolved!! We have known them for over 20 years and they are absolutely WONDERFUL people and would do anything for ANYONE in need. We too, are residents of Wedgewood Dr and we LOVE our neighborhood. I'm not sure If we would of been able to stay in our home if this incident had happened to us. With young children in the house and not being able to use the basement would be quite a task. PLEASE, PLEASE HELP THESE FOLKS IN RESOLVING THIS PROBLEM!!!!!!!!!!!!!! They have TRULY SUFFERED ENOUGH IN THEIR LIVES!!!!!!!!!!!!!!!!!!

To all who have been following this blog.....I just received a letter from Torringtons insurance co. saying the Statute of Limitations on this will toll on 3/18/2010 and is waiting for me to sign( $8.000.00) You don't need to comment on this( unless you want )Next step calling- attorney and insurance company again!Very frustang!!! Still paying taxws and NO HELP from Torrington!!!!!!

Imagine this - Torrington's insurance company paying somewhere around 20%, if that, of the damage. I hope no one is ever physically injured by the City. I can't imagine any hospital, doctor, rehab facility or whatever services the injured party needed accepting only 20% of the costs. Guess that means if you're hospitalized you get just one bone set, 12 stitches instead of 60, 1 1/5 meals every two days, you get the picture. It's not as though anyone involved in this case has a record of suing the City. Come on Torrington: do the right thing! I guess your budget for legal fees can afford to defend your position. Wait until those bills come in. I wouldn't be surprised if they exceeded the cost of the damages this family wants covered.

Update- Stature of Limitations was going to be up yesterday on this case. No choice...Torrington wasn't settling so had to file a lawsuit against the city. Not quite sure of chain of events now. Will keep the blog updated unless advised not to....

I was at their home when this happened & can't believe that it is taking this long to fix.Money will help to fix the basement up even tho it won't replace all the memories lost.We spent many happy hours downstairs.Haven't they suffered enough? If they owed taxes you would be right there.You owe them, so what is the problem?
