With all due respect to the City Official trying to help, the deed information provided in 2013 is incorrect. The property in question was properly restricted in 1994 and the relevant section of the restrictions reads as follows:
"4. Signage. No sign, advertisement, billboard or advertising structure of any kind shall be displayed to the public view on any portion of any lot within the Subdivision; provided, however, that signs indicating the street address and the names of individuals residing at that address (without any titles
or other professional designation whatsoever) shall be permitted on each lot and provided, further, that a builder, after receipt of a valid construction permit, may erect a sign on the lot for which such construction permit was issued, with such sign being removed upon the expiration of sixty (60) days after the builder obtains an occupancy permit for the structure being constructed on such lot. Notwithstanding the limitations set forth in this Section, “For Sale,” “For Rent,” “For Lease” and “Open House” signs shall be permitted on lots in the Subdivision. Any sign permitted herein shall not exceed six (6) square feet in size."
Please reopen the case. An examination of the 1994 Harris County records will show that the property in question was properly restricted at the time (and up to the present) and the deed restrictions of record will show the clear signage clause cited above. The proper remediation would be to rescind the 2013 sign permit and require the property owner to remove the billboard.
We understand it is awkward to get involved with a dispute involving a public political figure and his neighbors, so we thank you for your extended efforts to properly resolve.
