This has been a big problem, especially in the icy snow, but always.. there is not enough room between the fence and the sidewarlk edge for a wheelchair to get by, and the customers there have been very rude. The staff has been very rude. It should be thaty they might be given permission to put a table next to the wall,, but this takes up the whole sidewalk and is an obstruction to people trying to pass by.

They had always told the neighborhood association that they were grandfathered in.

Grandfathered in, how many square feet of space? How much per month? Maybe the Grandfather needs correction.

Never knew the answer to that. My understanding was that it was the affixed fence that was the exception as current law requires owners to pull their patio furniture in at night.

The affixed fence would not be a problem if it was not really a dangerous obstruction to passersby,, but it is an obstacle that causes people to have to walk singlefile way out at the edge of the sidewalk and causes problems all the time. There is a tree there also that makes the passage even more difficult. I like the tree.. the fence needs to be moved in closer to the wall. When it is closer to the wall enough to allow people to pass by easily then It can be permanent or not.

It would be common courtesy to allow full use of the sidewalk by pedestrians when you're not using it.
The previous establishment owner did take down the railings in the winter.

There is really no reason for the fence to be there in the wintertime, it could easily be some thing that could be folded up when not in use. There are no diners in it this time of year only smokers. I walk by there several times a day and it is a tight squeeze when there are other pedestrians. In my ignorance i never thought about a wheelchair but yes it would be very difficult to navigate there. There are also some rusted broken off pieces at the top of the fence and if you are walkking by and happen to use the handrail it is not pleasant.

It's a fence , relax. Shouldn't stress you out so much
