There is a fast growing maple tree on my neighbor's property that is on a slope and leans towards our cabin. We have written letters asking the neighbor numerous times to remove it even prior to building our cabin. But he won't. He lives in Utah. The tree has a Y in the trunk and each part is very heavy. Other trees nearby have fallen. It makes loud creaking noises and throws branches. I am very nervous about it and couldn't sleep last night with the wind. Is there anyway that I can compel him to remove it before someone is hurt or even killed? Thank you, Kathi.cahoon@outlook.com

I sent the neighbor another letter and had my lawyer contact him. My insurance guy sent me a letter stating that since the neighbor has been warned of the danger, they will seek damages if my property is damaged. The thing is, I don't want to wait until someone is hurt or something is damaged. These trees are not blocking my view and the arborist recommended several other varieties that could be planted that will not pose a safety hazard. The neighbor on the other side is this guy's relative and has his garage in the middle of the easement and has giving us a lot of trouble. We suspect that we are being held hostage over the tree because of our opposition to the easement agreement being violated by the garage.
The neighbor violating the easement, Robert Jusko, has made a nuisance of himself reporting gals allegations against us to every government agency that he has contact with through his job as some sort of legal assistant for a local navy agency.
In an attempt to stop us from building on our property that I purchased in 1999 before he had left Utah and come to live in the area, he tried to get state senator Maria Cantwell, the Army Corp if engineers, Fish & Wildlife, and Kitsap County code enforcement to address various charges that he made up to see if any would stick. He also file a spurious lawsuit again us alleging that we cut down trees that we were nit entitled to cut down. He cut down one of those trees himself in an attempt to draw attention away from his encroachment of the easement.
Another of the trees fell from his brother's property to mine and we had to remove it.
He has been exceedingly unneighborly.
Please address this issue of the tree before someone is hurt or killed.
