Description

For the last twenty years, this residence has been running a seasonal business (April-Oct, M-F, 9AM-4PM) from their home for children’s swimming lessons. This business results in continuous loud, distressful screaming by children that is unnerving, often lasts for hours and carries throughout the adjoining neighborhood. This business should be re-located to a community swimming facility such as the Palm Harbor YMCA, Dunedin Highlander Pool, Clearwater Country Club, Clearwater Long Center or similar venue that may not have existed at the time BA-12-10-98 Special Exception in an R-1, Single Family Residential zone was conditionally approved by the Pinellas County Board of Adjustment, instead of imposing the noise of their private business on the neighbors and thus destroying the tranquility of the neighborhoods. Although the noise in not currently occurring since off-season, we are lodging this complaint well in advance so that the business has adequate time to relocate and inform its clients prior to the new season.

Pinellas Count Code of Ordinances, Sec. 58-442 states:
“The making, creation or maintenance of such excessive, unnecessary, unnatural or unusually loud noises which are prolonged, unusual and unnatural in their time, place and effect of use affect are a detriment to the public health, comfort, convenience, safety, welfare and prosperity of the residents of the county.”

Surrounding neighbors have been more than tolerant of this disturbance for many years. However, situations have changed in the past twenty years – some neighbors are now retired or spending more daytime hours at home, and new neighbors who have had no knowledge of this disturbance have moved in (would the BA-12-10-98 Special Exception even be disclosed to them during their home closing?). We would all like to enact our rights to enjoy our property, both outside and inside (the noise level is sometimes so loud that it can be heard through closed doors and window).
