It is illegal to pass a car on the right if you have to travel on the shoulder of the road. Intersections like this force a driver to break the law since if you do the legal thing and wait behind the turning car, then others pass you on the right and then when you are ready to go, you risk sideswiping the car who is passing you illegally. I've seen tractor trailer trucks zoom by on the shoulder here. What if a pedistrian or bicyclist is on the shoulder? Perhaps a turning lane would be a good idea.
