We have received (4) other complaints regarding the same issue, so we are aware, and will be addressing the complaint. Having said that, what you propose is both not possible, as well as illegal. Our inspectors do not have the luxury of time to "stake out" a residence, as you suggest, waiting for someone to show. More importantly, just seeing someone leave any house does not automatically signify an illegal occupancy, or any other illegal activity. Nor, does it give us the authority to forcibly make entry into the property to perform any kind of inspection. Legal notification of the property owner must be done, so we can gain legal access and perform an inspection to determine if any violations exist.

I GUESS ITS OK TO HAVE AN ILLEGAL APARTMENT IN KEARNY,NJ. SOONER THAN LATER KEARNY WILL BECOME ANOTHER NEWARK,NJ. I GUESS TO WATCH TENANT EXIT ON A DAILY BASIS FROM 11:05AM-11:15AM IS AN ALL DAY MATTER. HOMEOWNER IS PLAYING GAMES WITH INSPECTORS. WHEN ITS A 1FAM HOUSE AND THERE ARE 2FAM. LIVING THERE ITS EVEDENT THERE IS SOMETHING WRONG.

After numerous complaints, and a number of inspections, this complaint is being closed. Future complaints will no longer be addressed without new or more definitive evidence. In order to prove or discredit the claim of someone leaving daily between 11:00am and 11:15am, (2) inspectors purposely went to the property at about that time. They were there from about 10:50am until just before 11:30am, no one left. The inspectors both, subsequently, were able to enter the property and perform an inspection of the whole house. No basement apartment was found, again.
