Illegally park cars, abandoned cars, and parking on an illegal surface belong to the TPD. Code Compliance told me "TPD enforces that ordinance which is 10.60.120. Code Enforcement does not have the authority to issue citations (tickets) so that is why TPD does it." Please forward to the TPD for enforcement.
I located the Mercedes in the backyard of the case address. IAW TMC 10.60.120 a resident can have a vehicle in the backyard for a period not to exceed six (6) months. Any other portion of the yard is not acceptable. TPD cannot do anything with this car for 179 more days. Code Enforcement IAW the 2012 IPMC 302.8 Motor Vehicles states that no inoperative vehicle may be left on any premise. Code Enforcement should be able to leave a Notice of Violation for the home owner to move it. If the home owner doesn't move it within their timeline, IAW 106.4 they should be able to assess a $100 fine to the person. I will forward this over to Code to see if they want to pursue it.
A vehicle on private property does not have to be tagged, insured, or operational on our end. I am following up with the TPD Legal Advisor on the unimproved surface parking, and will keep you posted.
Correction: I forgot that an officer had already come out to this residence. The owner will be given a 6 month time frame to correct the issue of being parked on an unimproved surface. If they are still not in compliance at that time, we can cite them. This request will be forwarded back to Code Compliance for the other issues mentioned, such as untagged or inoperable vehicles on private property.
Why would the untagged or imoperable vehicles violations have to wait 6 months for the parking surface violation? Seems these are separate and non-related.
When the car was parked on the south side of the garage there was no evidence it was not operational. We also could not legally view the tag from public access to confirm it was missing or expired. Therefore we had no evidence to open a case. Since then the car has been moved to accommodate the road construction in the alley. On 04/03/2017 we walked the muddy alley. With the car being moved to the front of the garage we could see there was no tag. We also noted additional violations. The maroon Mercedes has been cited for no tag, the yard has been cited for debris in yard and the grass/weeds were cited for being over 12”. TPD’s issue of being parked on an unimproved surface or in the back yard are no longer an issue since the car has been moved. The case will remain open until the car violation is remedied. M. Haugen
The Inspector went by property today. And the burgundy Mercedes with no visible tag has been removed from property. Therefore, this property is no longer in violation for having any other violations under the IPMC. This ticket is now complete.
