A notice is being mailed to the owner of the lot and it will be the only notice mailed for 1 rolling year. Time will be allowed for the lot to be mowed and any future violation within a year will be filed directly in court.
A follow up inspection was performed on 6/15/17, and it was observed that the grass was still in violation. Although the court date has not arrived the owner is being cited for a second violation, and should they fail to appear for the hearing additional actions will be taken to have the to have the issue addressed and corrected.
It is observed above that the defendant (company owner) failed to appear on July 25,2017, for his court hearing. There is a second affidavit pending in court and the hearing is scheduled for August 22, 2017.
Additional actions are being taken at this time by means of mailing a letter to the owner and declaring the violation to be a Public Nuisance, and ordering such person to remove the nuisance. And posting the property to be force mowed. Failure to remove the nuisance may result in the city taking additional actions.
Thank you for reporting this issue. This has been an ongoing problem for this area. Hopefully, force mowing the property and charging the owner will solve this problem.
NOTICE OF INTENT TO ABATE and DECLARATION OF PUBLIC NUISANCE letters was mailed to the owner and the LLC via first class certified - return receipt on 8/3/17, and these letters will remain in effect for up to one year. And an additional affidavit is being written today and it will be forwarded to court.
On 9/12/2017, the mowing contractor began cutting the lot but had a mechanical issue with their bush mower. They will return to property to complete the mowing of the lot, once the equipment is repaired.
If the mowing contractor has been contracted by the city, both need to know and acknowledge the contractor is not using the proper equipment to cut this lot.
I've monitored the work progression and it's pitiful, so why are we having to settle for a lesser standard of expectation here on this side of Mo. City???
Mr. Calhoun, why should this unresolved, ongoing issue need to be re-entered? You and we all know if this were our properties all CITY HELL would break loose!!!
More than a year has passed since the city last hired a contractor to mow this property.. On 8/27/18, I sent an email request to the property manager and mailed letters via certified mail to all parties of interest, and being that we have had constant rain in the area additional time was taken into consideration and allowed. I do know that the field holds water and would be almost impossible to mow during times of heavy rainfall. I will be forwarding this case to court, and additional actions will be taken this week to declare this property to be a nuisance, and if not corrected after being declared a nuisance, the city then may take actions to force mow.
