The "HOA," such as it is, is a voluntary organization with annual dues of $20, and exists strictly to deal with/allow the administration of the pool. I don't think it can be held responsible for trees or a vacant lot, not should it be unless it changes to a mandatory entity with much higher dues, which most of us don't want. A lot of people think the lack of HOA is a selling point, so maybe we need to work together to take care of such things to avoid a mandatory HOA- which always brings out the worst of the control freaks.

I don't think the HOA is responsible for the administration of the pool anymore. Those fees are paid directly to the pool itself (Olde Mille Swim Club). They may be responsible for the surrounding park area (Barlowe Field) but I think that as well has fallen under OMSC.

Having been on an HOA Board previously, I would recommend that if there is an HOA covering that neighborhood, someone should be able to refer to the governing documents. At some point (at least this was the case with the HOA I was in) any of the "public" lots that were remaining in the HOA were reverted to HOA control, meaning that the HOA itself should be responsible for maintaining those properties, as, after the last lot is built, the control of all the properties in the neighborhood should revert to the HOA itself to manage. That would include hiring of landscape companies, etc, to maintain all properties within the neighborhood that are for common usage.

Wondering if the area you are referring to (looked it up on Google Maps, but haven't looked at in in person) is one of the designated Woodlands Preservation areas. I have a similar area behind my house. If so, you may have some problems with getting the issue resolved unless you can get someone from the county to send an arborist out to verify the problem and fix it. You aren't allowed to remove any live vegetation from those areas without prior approval.

Find out to whom the property is needed and their inheritors, that would be the owning and responsible party, not the HOA.

Nancy Stracke, I was mentioning the pool because it was mentioned in a previous comment (and again after your comment). I have not paid any fees to the HOA. As far as I knew, the pool was maintained by Olde Mill Swim Club (who I have written a check to annually to maintain my membership there).

Pool fees pay the bills (power, maintenance, life guards, insurance, groundskeeping, etc.) The HOA are volunteers who manage the pool and Baldwin Field.
