properties: 125,127,129,131,133 all on 86th ave. have significantly increased the rental turn over rate in recent weeks to sometimes nightly rentals. Are these two property owners in compliance with the code? What does the code state as to the number of times these units can be rented each year?

The Code Enforcement Officer has been driving past these houses frequently and recording license numbers. So far only one change in occupancy each.
At this point -- city staff has not observed enough evidence to testify at Code Board. If "frank" would contact Del Powell and guarantee that you can be at the Aug. code board meeting and can swear under oath of the number of changes of occupancy -- the staff can act on this complaint. Unfortunately -- staff does not yet have enough evidence to testify to the activity yet.

This case had gone to the Code Enforcement Board. Before the 2nd hearing could occur, the attorney for the property owner filed suit against the City in circuit court. This matter was being handled by the insurance counsel of the City.
At this point, the rentals appear to have halted. The City will NOT be taking this matter back to code enforcement board with 2017 data. If the short-term rentals again flourish -- staff will take the matter back to the code enforcement board as a 1st time offender. This property is NOT grandfathered for short term rental. It has the same rental restrictions as the rest of the neighborhood. No more than 5 changes of occupancy per unit per year.
