1875 BOSTON AVENUE - CVS PHARMACY/CAREMARK - COMPLAINT/VIOLATION RESOLVED (May 5, 2017, ZEO Neil H. Bonney. Also see corresponding Q Alert Complaint 320061 (this is C Click Fix #3430364).
This Zoning Complaint has been on-going since 1989 - with Multiple Complaints, Multiple Violation Notices sent and Multiple Sent/Issued "Prosecutor Summons Request" and/or "Affidavits" to State Housing Prosecutor ( by three consecutive Zoning Enforcement Officers to three consecutive State Prosecutors). This time the complaint was the same - Tractor Trailers being parked in the rear parking lot - both overnight and weekends - as a "Layover" for tractor trailers (the increase of some of the complaints this time - could have been as a result of Salamonte's Tire Company moving in next door, the Truckers getting kicked off the lot at the hotel on Lordship Blvd, and also the involvement of the Mill Hill Neighborhood Revitalization Zone representative and subsequently the OPED/Mayors Office Representative.
End result/resolution after NHB having submitted an 'Affidavit" to the State Prosecutor approx.. 7 months ago - resolution came after a dialogue between NHB, the owner (which this property is part of an investment portfolio w/triple net lease to CVS), and a representative from CVS Pharmacy/Caremark Corporate Legal Department in Woonsocket Rhode Island. After many telephone conversations, emails and registered letters - CVS Pharmacy/Caremark had their Maintenance Company put up a four foot tall - black coated - chain link fence (week of May 1 to 5, 2017) (at a cost of approximately $8,000.00 to CVS) around the perimeter of Fairbanks Street and Success Avenue - to prohibit this "pull into activity of long haul truckers" - as an unapproved/illegal truck rest stop. CVS access is still via Boston Avenue - in between the CVS/Caremark Pharmacy Building and their neighbor to the N/W building. This access also gives access to the Refuse companies of CVS and their neighbors.
The State Prosecutor was notified of this resolution of this complaint/violation (and made aware of the time period of this complaint violation - from beginning to end -
1989 to 2017). The Prosecutor may now "Nolle" this complaint - per Zoning Enforcement Officer Neil Bonney's May 17, 2017 email.
As an ending in Neil Bonney's email to the State Prosecutor notifying her that the fence was installed - to keep the Long Haul Truckers from parking in this back lot of CVS... he wrote :
"To say the least - I am gratified that CVS/Caremark and the owner of this property came to understand the nature of this Zoning Violation and the Communities need for something to be done about it". Zoning Complaint/Violation RESOLVED - 1875 BOSTON AVENUE/ CVS PHARMACY/CAREMARK
