Try calling PWD right of way management 238-3651 to find out if this is being caused by an official city street tree. If it is the city is required to fix it and the use of asphalt it in violation of there own rules. If this is not an official city street tree then it is the responsibility of the fronting property owner for sidewalk maintenance and repair ( Section 5610 of the Calif State Streets and Highway Code and Section 12.04 of the Oakland Municipal Code).
