From a letter sent out by PWD Bureau of Engineering and Construction 238-3651. " Please note your sidewalk damage may not be caused by an official City tree, State Law and local ordinances hold the owner of the fronting property responsible for sidewalk maintenance and repair ( Section 5610 of the Calif State Streets and Highway Code and Section 12.04 of the Oakland Municipal Code)". If the damage is caused by an official street tree the city must do the repairs in concrete not with asphalt. They are also now using thick plastic material in the tree wells to prevent this from happening.
