This is not a ticketable offense. This, if it is determined to be a violation, will go through a zoning process which is lengthy and time consuming. this will not have a quick resolution. We are aware of the numerous violations in the new north end. Until the laws change then this will continue to be a lengthy process.
Aware that this is not a ticketable offense. How long does a violation need to occur for it is determined to be a zoning violation? This has been ongoing for over 4 months.
It's starts with a notice of complaint. Even more difficult when someone does it anonymous. Then an investigation takes place, looking for a site plan and a determination of how long the parking has been happening. Then a determination is made. If a violation is determined then a notice is given and the owner has a time frame to respond. Then if no response the violation is pursued through Planning and Zoning. Then attorneys get involved and things take longer, drafting legal notices. If the owner appeals then it goes to the DRB hearing and the citizen panel makes a determination. Then the owner has a period of time to clear the violation, up to one year or a set number of days to appeal. If the order gets appealed then it goes to environmental court which generally takes 2 years. If the owner then disagrees then they have the option to appeal to the supreme court which will take years. If anytime the violation goes without action for longer than 12 months then the process starts all over again. Now lets multiply that times the number of complaints city wide, let alone on the north end and you have a recipe for a long process.
So there is no easy answer, each complaint is an issue all it's own. And I am not the one who is doing the violation process, I was just assigned this. I have seen these take years to get resolved.

Almost seems like it would be easier to convince the City Council to change the ordinance so Ward 4 and 7 were not expect from the yard parking rule. Makes no sense that the Yard parking ordinance to minimize erosion from non-point source pollution is not enforced equally through the City.
Its always been my opinion that Ward 4 and 7 were exempt because the yard parking ordinance has less to do with the environmental impact and more to do with control of citizens/college students parking everywhere.
