Cable TV is not a Town owned utility. Century Link pedestals are not the property or the responsibility of the Town of Gilbert - they are in a public utility easement. Town staff has been advised by Century Link that the duct tape is a temp fix until all of the pedestals in this area are replaced. I respectfully disagree. The Town has authority under it's cable license to enforce standards in the PUE. The Town has a contract with CenturyLink for a Cable TV license. That contract cites Gilbert municipal code Chapter 18 - Cable Communications as the ordinance. Under Section 44 of chapter 18 it clearly references compliance with construction and technical standards. Those standards are the "Gilbert Public Works and Engineering Standards" (specifically 11.3, Town Standards for Public Utilities). CenturyLink will roll over Gilbert if the town allows it. You have to stand up to them. The Town of Gilbert has the authority to withhold permits until these issues are resolved under their contract. I know this because I contributed to writing the model cable ordinance. This issue should be looked into by the Manager or Attorneys Office.
It does not appear that anything is being done about this issue. If the Town does not feel responsible, please post a reply from CenturyLing explaing how the Town does not require them to upkeep the equipment in the ROW and POE, and that it is accepted practice in Gilbert to have rotted and disassembled metal boxes in resident’s front yards.
Metal pedestal at this address has been replaced with a waterproof composite pedestal. Century Link will begin replacing all deteriorated pedestals in this development.
