Car parked off the approved driveway
A notice of zoning violation was issued to the property owners on June 1st. They made an “attempt” to remedy the situation with a zoning permit application on June 25th to reconfigure the driveway. That application was not completed as required w/in 30 days and was denied last week. So, we have an un-appealed, enforceable zoning violation notice in place. It is in the queue for enforcement action in the courts via the city attorney’s office.
Once the Enforcement Action is filed at Environmental Court by the City Attorney's office, the court will give the property owner an opportunity to respond. Ultimately the judge will decide on the appropriate penalty to the property owner for non-compliance. The judge could issue a finding against the property owner with a penalty of up to $200 per day that the violation continued.
Until the judge's ruling city staff will continue to monitor this as we have, and issue the vehicles $75 tickets each day there is a violation.
The boulders are being placed now. The cars are unable to access the area off the driveway.
