Apparently there is an issue with who actually owns the property that the tree is one, because when I asked my landlord about something related to the creek, they told me that the city doesn't want to claim responsibility, but neither does the man who owns the property on the other side of the creek (the side the tree fell from). That's why there's a huge hole in the fence that leads down to the creek, and a bunch of nasty garbage down there- the city says it's not their responsibility- but it's a creek running under city streets, so I don't understand how the city could NOT own it.

The huge tree that fell was located on the top of the bank of the creek. I believe the city is responsible. The city should 1) clear the tree from the creek as it is currently a fire hazard and will be a flood hazard during the rain season 2) study the other trees nearby to see if some should be removed before causing future problems

As of 10/24/13 the tree is STILL in the creek! This is TEN months after it fell! It is still a fire hazard and will be a flood hazard. If a fire or a flood happens, the courts will be busy. CLEAR it up to avoid problems!!!!
