Public works doesn't have the ability to issue fines. Only the POLICE department has that ability. If you are not willing to call them at the time of the incident then there will be no fines.

From the license application on file from Cassella Waste Management:

"I certify that I have read the City of Burlington’s solid waste ordinance (Chapter 14, Burlington Code of Ordinances) and regulations. I understand that failure to observe the law and regulations could result in a revocation of my license to collect solid waste and recyclable material within the City of Burlington. I also certify that I understand the City of Burlington has a
Noise Control Ordinance (Sec. 21-13, Code of Ordinances) and that I cannot begin the collection of solid waste or recyclable material before 7:00 a.m. unless previously authorized by
the Public Works Commission and the Department of Public Works.
I further certify that I will provide to the Department of Public Works all necessary records as required by ordinance or regulation, in the format requested, in a timely manner.
I further certify that this document has been examined by me, and is, to the best of my knowledge and belief, true, correct, and complete."

Would TMiles (Verified Official) please direct us to the agenda and minutes of the Commission meeting showing authorization for Cassella to provide early pick-up at this address. If NO prior authorization by the Commision AND DPW, and following prior contact of Cassella by DPW's R. Greene in June, the DPW IS authorized to pursue "a revocation of...license to collect solid waste and recyclable material within the City of Burlington". As a verified official, could you please add this to the DPW's agenda for its 18 July 2018 meeting? (Sometimes the buck does stop at DPW.)

There you go, YOU provided the ordinance in support of my comment about calling the police. Thank you very much.

I think the desired outcome is for trash collection to begin after 7:00am here and throughout Burlington, as required by law. Relying on the police department to issue fines is probably not feasible - I doubt they can respond quickly enough.

I am a city employee and that is my name. I don't hide behind fake names. If giving people the CORRECT information to deal with their issue is "Unprofessional" then I accept your compliment. Heck, I might even use that name in the future. The answer still remains the same. The complaintant has to call the police as they are the ONLY department that has that authority to deal with noise complaints. They can call the officer in charge or the deputy chief and explain their issue.
That having been said, more than once, I will NOT post to this thread again as this is not a public forum nor a place for debate.

Tmiles, thank you for providing the correct information. What I find unprofessional is your general tone and lack of concern for this complaint. While the information you provided is correct, you have responded with all-caps (perceived as shouting) and sarcasm. This issue has a real impact on the quality of life in our neighborhood and I expected a higher level of service and concern from our city government.

According to the helpful information OldVtr provided, it seems that DPW could provide an avenue to resolve this issue since they manage and authorize the license for Casella to operate in the city. Casella and other haulers who collect before 7am are clearly breaching their agreement with DPW (unless they've obtained an exception for the location). In the past, DPW officials have called the hauler to remind them of the ordinance. In this case, Casella was called, but the issue has not been resolved.

The next time this happens, I will call Casella and the police department. If that does not resolve the issue, I hope that DPW will consider holding the hauler to their agreement in some way, or revoking the license.

DPW has contacted Jeff Lavine he reports that he will contact the driver and stop the early pickup.
