This tree is UNBELIEVABLY small/young to be planted in this area. I think replacing it with a bit larger tree would be appropriate.

As President of the HOA nearest the curbstrip where this tree was planted, I can assure you that this tree was not planted by "the HOA." Our Landscape Committee assures me that this tree, like all others on this curbstrip, was planted by the city.
