Thanks First Warder, appreciate your insight. From any perspective it sure looks like the trash is on the property south of the unimproved gravel drive (aka Bingham St.), and also 12-15' south of the metal RR safety barrier. Hard to understand how COH can make that claim unless the RR has a right-of-way or easement much wider than the safety barrier. Do you know anything about this, or if that makes any difference who's responsible for maintenance?

RR does have an easement, not sure what it is, but regardless, the cofh will pass the buck any chance they can get. I've emailed our city council person about all the illegal dumping in the area with no response. Problem is getting old.
