Description

Baco's Pizza and Natalia's Alterations have several high output light fixtures on the exterior of their buildings. The rear of Natalia’s home/business has a high wattage, HID, high pressure sodium flood light that is angled to illuminate the back of her parking lot and property. This type of fixture is not a full cut-off type of luminaire which is the type of luminaire that would be necessary to adhere to the zoning code. The fixture is mounted on an adjustable knuckle and should be pointed with the lens down at 0 degrees nadir in order to meet the code. This fixture creates a night time glare to friends and family that may be in my back yard at night, so much so, that eventually it creates eye strain and headaches when trying to walk or face the direction of the fixture with the contrast of the darker ground and black fence. Several times, friends and family have gotten their clothing caught on her fence due to blinding glare of the light fixture on the back of her property. This fixture remains on all night from dust until dawn. Natalia’s Alteration’s un-posted business hours are no later than 5:00 PM any day of the week and on weekends she’s only open for a few hours during the day.

Baco’s Pizza has several light fixtures mounted on the façade of the building as a means of decoration. These fixtures don’t have an engineered prismatic lens nor do they have scientific or engineered photometry, thus making them purely decorative and also a “glare bomb” (industry term). Baco’s also has a high wattage, flood type of fixture on the back of the building which is being used as a “grow light” for a small garden that is planted next to the external box freezer. The exterior lighting at Baco’s property is “ON” from dusk until 11:00 PM, 7 days a week, 365 days a year.

There are are two utility poles at the front of each property where there are two (one on each pole) high wattage, HID, high pressure sodium flood lightS. These flood fixtures are on from dusk to dawn. CL&P has recently adjusted these fixtures, torque to the furthest angle down I assume, but the fixtures are still a major glare nuisance to the adjacent properties. These are privately leased light fixtures by either Baco’s or Natalia’s Alterations and are maintained by CL&P. I have researched, and no other properties on Enfield street have these types of fixtures, not even the bank or the North Thompsonville Fire Station just a block away. The town has allowed these fixtures to remain regardless of the obvious glare nuisance and prior complaints.

The ordinace that I've referenced:
7.10.6 Outdoor lighting.
All external illumination shall be directed or shielded in such a manner that the source (bulb, tube, etc.) of light will not be visible from any street or from any adjoining property. No light shall be directed outside the lot where it originates. All lighting shall be shielded or otherwise designed to provide down lighting so as to minimize night glare.

The Town of Enfield has these zoning codes that are supposed to enforced but have neglected to do so in this case. At this point, it’s of my opinion that the Town of Enfield is the neglectful party and is responsible to either start enforcing the code, change it or explain why the Town is allowed to give special accommodations to these business’ above and beyond what the citizens of Enfield are allowed. If these parties don’t have to adhere to the code then it discredits any other current code enforcements. Neither of the business Owner’s at Natalia’s Alterations or Baco’s Pizza have State of Connecticut vehicle registrations so it’s obvious that they don’t live in Enfield, or the State.
