Code Enforcement inspected this area on 05-30. There is no address of 12007 Lagoon Ln. The stop signs at Lagoon Ln and 120th Ave are not obscured, however, the stop sign on Lagoon Ln at 121st Ave is covered by the hedge.

Code enforcement mailed a Courtesy Notice to the owner in Nevada to trim the hedge within ten days (06-11).

Public Works will clear enough to ensure the stop sign is visible for the safety of the motorist. The owner is still responsible for the majority of the hedge.

I used the map so the address is probably not correct. It is on the east side of Lagoon Ln (on the right side as you are traveling north) before the 120th stop sign. If people with disabilities are utilizing adaptive bikes that sit low to the ground, the stop sign is obscured. Here is the important part, what does the county and / or municipal code say about the minimal distance that a bush or hedge can be adjacent to a public road because this hedge / bush is zero feet from a public road? If a car swerved, there is no escape from being hit because the bush / hedge blocks the escape. Also, what does the county and / or/ municipal code say about the maximum height of bushes / hedges that are adjacent to public roads?

(a) It shall be unlawful to plant trees, bushes and/or hedges with deep or widespread root systems over, upon or within ten feet of the paved portion of the city owned rights-of-way or easements. It shall also be unlawful to plant trees, bushes and/or hedges with deep or widespread root systems within ten feet of any city-owned underground sewer lines.

Sec. 68-458. - Garden walls, fences and hedges.
(b) Front yard. Decorative walls, fences and hedges within the required front yard shall not exceed 36 inches above finished grade. Chain link type fences are specifically prohibited in front yards.

Hi, what was the process of notifiying property owners and how much time do they have to remove the hedges / trees prior to the city removing them and sending the property owner(s) the bill?

In addition to seeing the hedges everyday as I am on Lagoon Ln, I received an email notice that it has been over 30 days since this was open and Bulding and Code Enforcement acknowleged that these are out of code and need to come out. What is the status of notifying owners and when if the owners ignore the notification will the city take action by removing them and then charging the owners back the cost?

It has now been over 40 days since I brought to the attention of the code compliance office of obvious code violations and I have requested two updates (14 days and 5 days) and yet no response from the code compliance office. WHY? Who is assigned to this because if there were an accident either with a pedestrian or an automobile, your office holds some liability? As I have not seen any corrective action.

These bushes do not have deep or wide-spreading root systems.

So it is nearly 30 days and they have not been trimmed. What next?

Now for 120th. Have your code enforcement drive north on Lagoon Lane and the bushes on the right hand side are 5 ft tall before 120th and extend onto Lagoon Lane 9as seen in your own photo). And yes those types of bushes do have both deep and wide spreading systems that is how they do well in a sandy environment. In addition, you also have storm water drains in that area.

It is 100% safety concern because a pedestrian is not able to move out of the street of traffic when a car passes. They would be trapped and we all know how nearly 90% of the automobiles do not come to a complete stop at each of the stop signs on Lagoon Ln.

There is a 15 foot wide right of way on Lagoon Lane. A pedestrian sidewalk cannot be established on this roadway because of the limited width.

I have reported your concern about vehicles not stopping at the Lagoon - 120 A and 121A intersections to the police dept.

If the hedges by 121st gave not been trimmed, why are you closing this?

As far as 120th those hedges extend into the roadway. Why wouldn't they be required to be trimmed back off of the roadway?

We are now at 106 days and yet none of the hedges have been trimmed down to 36 inches along Lagoon Ln. As stated in the regulation below.

This has been submitted to the public works dept in a work order for the 119, 120, and 121 block of Lagoon Lane to trim vegetation down to 36 inches

There has been no results or trimming of hedges taller than 36" from your courtesy notices to residents along Lagoon Lane.

As the code reads,

This has now been open 8 months with no results. Either it is a violation of code or it is not and there are fragrant violations along Lagoon Ln. By not enforcing the code or using your discretion on what codes to enforce, it is the example of the Black Swamp on the municipal level.

Why are you closing when they are still in violation? Either do your job or find other employment.

If you close again without justification that all violations have been cleared, then a complaint on the enforcement officer will be made.

Almost 11 months now and neither the homeowner or the public works have trimmed down the hedges to 36" as stated on 9/12/19 and as seen in the photo on 7/08/19 per sec 68-458. They also have grown over onto the street by in some cases 4 to 6 inches

The CID staff has decided to grant an Administrative Waiver for the hedge at 11921 Lagoon Ln. The property owner provided proof that the hedge existed prior to enactment of the City ordinance and therefore it is grandfathered. The Public Works Department inspected and had no objection to the location or height of the hedge. Treasure Island PD has no record of any accidents at this intersection. CID staff is closing this case.

When was the administration waiver granted and post the actual administrative waiver with names and signatures who granted?

With the horrific bicycle accident that occured between a bicyclist and the Madeira Bch garbage truck that occured a few days ago, a waiver may be a very poor choice in judgement and any attorney in Florida will hold the grantor of the waiver as well as the City of Treasure Island liable when an accident does occur.

If you decide to close this again without the proper action, I will raise this to the county and state level. They will have access to see who closed this without a subpoena.

It is now 365 days, do what you are paid to do by mine and other property owners.
