Description

Dear City Planners/Council Members:

My family and I live next to the former Church at 260 Pacific Avenue that is slated for rezoning/redevelopment. We attended the required community meeting presented by the owners architect and attorney. The drawings distributed show the building to be extended to within 15 ft of the rear property line.
There are two 80-100ft very health 150 yr old trees in the yard that would be chopped down if this building is extended to the rear this far.

Do we have any type of program in Jersey City to protect our tree Canopy?

I am sure we can all agree that a 15ft curb tree would be a comparable give back either.

I thought a building can only cover a certain percentage of the lot space. You can't build to the extreme edges of the property line. As far as I know the intention is to make sure there is a place for runoff to drain.
I'm wondering how this developer is being allowed to develop such a large amount of the lot when regular one or two family homes being renovated are not allowed.

As per parks and forestry, they cannot prohibit any tree removal that does not fall in the public right of way or City property. City planning was emailed, we are waiting for a response.

CCB....normally they cannot build to back of lot but. In this particular scenario they are trying get the zoning changed to adaptive reuse which will allow the rear addition.
Also many times even when already zoned for residential the developers ask for variances to cover most of the drainage soil area because they have the city convinced they cannot make money without expanding the construction.

The city is working with residents and the planning board to protect the tree which is still currently being evaluated.

HA! Do they bother looking at comp prices in the area? At the speed and prices places are being bought all over this city you'd think that would be a harder sell. Maybe not AS MUCH money, but I can't imagine they won't be making any. I appreciate that there should be some flexibility, but it seems like they hand out variances so frequently I'm not sure why the rules are there in the first place.
Considering the low lying area it seems like having enough drainage would be more of a concern as well.
We appreciate your efforts to save these trees!

As per Matt Ward, City Planning, the ordinance regarding the adaptive reuse of 260 Pacific Avenue is being scheduled for council on Thursday 10/10 and Wednesday 10/23.

At the same time the city is promoting the planting of much needed trees for a greener and healthier environment, isn't it ironic that the planning department would allow variances to zoning regulations that would allow two fully grown and wonderful trees to be chopped down? Shame, Mayor Fulop!

Per City Planning, it is anticipated that any future development at 260 Pacific Avenue will commence in a manner that preserves at least one of the two large trees. An ordinance passed through the council permitting the adaptive reuse of the church at this address which permits a rear addition.

Trees are still there. No work has commenced. Also no further information on what is the status of the project from city.

Per Matt Ward, "[The is] an application for development at the site in question. I believe the application preserves at least one of the two large trees in the rear yard of the property. I've cc'ed Erica Baptiste who is the review planner. I believe it is tentatively scheduled for a planning board hearing on august 11th."
