A. There are no laws against taking photos of people in public
B. He was caught breaking the law by a very good friend of mine--in that friend's backyard.
The friend asked for permission to take his picture. While we don't have a model release, there is no law being broken.
This falls under a lot of other similar legislation which boils down to (in this case) "Don't trespass illegally if you don't want your picture taken".
Photos of minors have recently been published via in-store & out of store security cameras when they've committed crimes. This is no different.
