    Platinum Auto Body is illegal parking their clients’ vehicles in public street parking. This has been reported multiple times previously with no action taken by the city of Berkeley - if there’s a better way to report this (directly to the BPD?), please let me know, otherwise take action please. There is limited public parking in this area and a company taking advantage of the public parking is very frustrating, unethical and illegal.

    The owner of the home at 960 45th St is encroaching on the sidewalk by leaving an over-sized, commercial painting or curing oven obstructing the public right-of-way. This obstruction presents not only an inconvenience but also a hazard, as it obstructs the majority of the public sidewalk. The obstruction has been located in the exact same location and has been unmoved for over 4 weeks.

    In accordance with City of Oakland Ordinance 12.08.030, there is a “minor encroachment” (defined as: "an encroachment into the public right-of-way resting on or projecting into the sidewalk area, but which is not structurally attached to a building") on the sidewalk in front of the home. Currently, the encroachment is in clear violation of Ordinance 12.08.100 in the following regards:
    -A clear space of 5' 6" is not available for public use where the encroachment is established
    -The encroachment is materially interfering with the public use of the sidewalk
    -The encroachment is endangering the public welfare and convenience
    -The encroachment extends farther than 2' from the property line into the public right-of-way

    According to the city ordinance, a minor encroachment requires a permit granted by the Director of Planning and Building granted to the owner of the building.

    I'm requesting a formal review of the permit for the minor encroachment in accordance with City of Oakland Ordinance 12.08.080 including the following:
    -The Director of Public Works (DPW) review the permit application for the minor encroachment
    -The DPW conduct an investigation made at the site of the encroachment installation including the dimensions and exact location of the encroachment as it pertains to the sidewalk area, the public right-of-way and the public health, safety and appearance of the sidewalk.
    -Review of fees based on the scheduled encroachment installation
    -Review of liability insurance filed with the City Clerk (including a copy of the certificate of insurance) showing adequate liability coverage for the encroachment and naming the city, its agents and employees as additional insured under the laws of the state of California (minimum liability insurance of $300,000 per occurrence).

    If the permit is found to be null and void (based on the failure of the owner to comply with the conditions established within the permit), I'm requesting formal termination of the permit by the Director of Public Works, as it would be in the city's best interest. At that time, I'm requesting the City of Oakland formally provide a Notice to remove encroachment to the homeowner.

    If no such permit exists, I'm requesting enforcement by citation for the encroachment and/or lien placed on the home until the encroachment is removed.

    Per Oakland Code Section 12.04.030, the City Engineer should repair this sidewalk and put a lien on the property. The sidewalk in front of 960 45th St has been torn up for over a year by the tenant of the home. There is non-structural plywood laying full length across the sidewalk which is not merely unsightly but poses significant safety issues (trip hazards, structural integrity hazards, possibly trenching/excavation hazards). It does not appear that any work has ever been attempted to remedy the situation, but it actually is getting worse: recently, the extent of the damage appears to be increasing as there are now additional boards laying across the sidewalk posing even more hazards. There also appears to be a temporary, stolen road hazard sign with a handwritten warning about hazards, which is obviously insufficient per a simple job hazard analysis and obviously not temporary, as it has been there for over a year. This is a public sidewalk and it seems like no attention has been given to it from anyone in Public Works, from the City Engineer and certainly not from the tenant. The repair area is greater than 25 sq ft, which requires a City permit, yet I️ don't believe a permit has ever been pulled nor anyone has ever required it (and if so, it's highly doubtful the permit extended for over a year). Over the last 12 months: I have witnessed numerous people trip while walking through the unpermitted construction zone, saw a blind individual nearly kill himself and fallen myself when out for an early morning job. Perhaps the City Engineer will pay attention once an injured individual or the ADA (or both) bring a lawsuit against them.
