    We live at 2091 Massachusetts Ave NE on a water front lot. Subsequent to the purchase of our property, our neighbors at 2097 Massachusetts Ave NE have planted and maintained hedges (from 16.40.040.2 'Definitions' “Hedge” means a continuous arrangements of three (3) or more shrubs which are planted and maintained to create an open space less than two (2) feet wide) that is within five feet of the waterfront boundary line. Additionally, these planting extend into the primary view corridor.

    It is our interpretation that this is in clear violation of the City of St. Petersburg City Code – Chapter 16, Land Development Regulations, Fences, Wall and Hedge Regulations, which read, in part:

    E. LOCATIONAL CRITERIA (cont.)

    2. In waterfront yards, a hedge shall not exceed three (3) feet in height within a primary view corridor consisting of the first five (5) feet measured from the waterfront boundary line. The primary view corridor shall additionally include portions of the waterfront yard, on each side of the waterfront yard, located as follows: From a rear corner, measure along the waterfront boundary line for a distance equal to one-half of the depth of the waterfront yard to a point. From that point, extend a straight line to a point where the waterfront setback line intersects the nearer side boundary line, and from that intersection, return to the corner. In the remainder of the waterfront yard there is no limit on the height of hedges.

    We have raised this issue with our neighbors on several occasions, with no satisfactory resolution to date.

    We are requesting that the City of St. Petersburg take appropriate actions with the property owner at 2097 Massachusetts Ave NE to make their property compliant with the Code as their violation is affecting enjoyment and use of our property.
