So we homeowners get the benefit of an approved PUD, including landscaping, with this type of tree recommended by the City 25 years ago. We have trees that are the responsibility - mandated by our documents and the city - that belong on a neighbor's little 5 foot swale that are encroaching on another neighbour's property destroying the non-owner's property. So how does one tell his neighbor that the tree he is responsible for, is breaking up the other owners property and responsibly?

Sure sounds like code enforcement to me or at least an association responsibility for notification. We should not have to get into disputes with our neighbors.
