Health acknowledges. There is nothing health can do about the rooster being annoying but we'll take a look and ensure they are in compliance with the health code.

I believe code says you can't put your coop within 50 ft of a residence. The rooster is allowed but it would fall under the noise ordinance the same as a barking dog I believe. Which would be CPD's jurisdiction.

Correct...of "any" residence so if they don't have enough room on their property, then they will have to get rid of them.

I don't know if any coop in our neighborhood could be positioned 50 feet away from a residence as the homes/apartments are so close together. Regardless, the noise is a violation on its own.

Gentleman this is a growing problem and we need one department to address it...
Before it gets out of control. I will ask Joe in the law dept to look at our legislation and see if we can amend it to address noise.... The law department is helping to refine my nuisance ordinance that could address this situation but they have not rolled it out yet. Peel Colman has a boom box ordinance but that is far from a chicken or rooster.

Councilman West ... there is no need to amend the ordinance ... it's already covered :) 509.11 (2) spells it right out :)

509.11 LOUD AND DISTURBING NOISES PROHIBITED.
(a) No person shall make, permit or cause to be made, any unreasonably loud, disturbing or unnecessary noise of such character, intensity and/or duration as to disturb the peace and quiet of the City.
(b) The following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this section, but such enumeration shall not be deemed to be exclusive.
(1) Horns, signaling devices, etc. The sounding of any horn, bell or other signal or warning device on any automobile, motorcycle, bus or other vehicle, except as a danger or warning signal, but any such sounding of horn, bell or other signal or warning device as a danger or warning signal shall not be unreasonably loud or harsh or continued for an unnecessary length of time.
(2) Animals and birds. The keeping of any animal or bird which by causing frequent or long continued noise shall disturb the comfort and repose of any person in the vicinity.
(3) Defects in vehicle or load. The use of any automobile, motorcycle or vehicle so out of repair, so loaded or in such manner as to create loud or unnecessary grating, grinding, rattling or other noise.
(4) Loading, unloading, etc. The creation of a loud and excessive noise in connection with loading or unloading any vehicle or the opening and destruction of bales, boxes, crates and containers.
(5) Motor vehicle exhaust. The discharge into the open air of the exhaust of any motor vehicle, or internal combustion engine, except through a muffler or other device which will effectively prevent loud or explosive noises therefrom. (1964 Code §507.49)
(c) Whoever violates this section is guilty of a minor misdemeanor.

I agree ! Now it comes to enforcement....

Good luck but you'll never get anywhere with this. I have a resident on 18th ne who has a rooster and chickens. Nothing that council or the law department can do.

Sorry - been working on this but did not get post up. I spoke with residents last week. They have 5 hens and 2 roosters. They got them at Easter last year. They do not want the roosters but did not know how to get rid of them. I gave their information to a citizen who resides in township and hope the roosters will be gone in next few days. They plan on moving the coop so hens are 50 foot away from homes. I will be checking status next week. /// Gus Dria

thank you Gus, that is the correct answer it is a noise violation there for it can be cited by police....................................any noise that is audible after 50 ft...........but in the same sense it also states that any kind of annoying or habitual noise being commit is under noise curfew and so there for in whole disturbing the peace..............

5/15 - The roosters are gone. Resident has not completed new coop location. He hopes to have completed this weekend. Will recheck next week. When I was there, I could not hear the hens.

5/19 - visited property. They have 5 hens that are 50 foot from houses. No public health nuisances observed at this time. Case closed. /// Gus Dria
