Description

There is a significant road defect on Clerk between Claremont and Myrtle on the left hand side of the street closer to 82 Clerk. There has been an underground possibly water main issue persisting for about a year now that keeps causing the pavement on top to sink. At its worst, this has caused 2-4 different uneven pavement situatoins, each about 1.5" in diameter to 2-4" in diameter with a significant height differential, sinking about 2-4" if not more. The city has been out now 3 times to try to fix this and each time has been unsuccessful. The first time, about a year aog, they simply tried to patch over it, but within a week or so the patching failed, crumbled, and made the situation worse. The second time, they actually cut into the pavement and did what appeared to be a more thorough investigation/repair, but this too eventually failed, as for about 2-3 months now, the pavement has sunk again, even worse than before, causing multiple large pavement level differences and large potholes. The city came out yesterday and sprayed tar over the holes but this did absolutely nothing to repair/fix/remedy the actual issue.

This needs to be fully investigated, repaired, and completely repaved, not just patched.

The prior repairs have left our sidewalks in shambles.

We pay as much in taxes, if not more, than the people downtown, by Van Vorst Park, by Hamilton park, etc. We deserve to have the same level of care shown to us by the city, especially as it relates to infrastructure issues which cause not only hazards to pedestrians as we now have severe and significant tripping hazards, but hazards to cars and to our homes.

The city is now on notice of this issue and has been for months - almost if not more than a year. This must be addressed, and properly and quickly. You cannot hide behind the Tort Claims Act any longer if you fail to properly address this and someone gets injured or experiences property damage due to the city's absolute failure to fix this properly.

Please contact me ASAP to discuss how this will be addressed, including a specific timeline of what is proposed to be done in terms of a full investigation and proper repair of this area.
