Appears that the developer did come out...but all they did was rehang the realtor sign that had laid in the dirt for a few weeks. Can we expect that they will remove the graffiti, complete the sidewalk, and repair the street sometime soon?

Good to hear…given the size of the builder they should have no problem getting someone out very soon! In the meantime, could they at least clean up the graffiti and litter and weeds? Not a good look for a property they are trying to sell!

The builder is currently trying to find a contractor to do the asphalt work. Unfortunately per city standards no overlaying of asphalt can be done October 1st through May 31st because of temperature and criteria needed for asphalt. Sidewalk and curb can be done at anytime but do not have a schedule from them yet for that. Thank You

The builder has been put on notice to complete what they can but has not replied as of today. I will try to contact them and see what the schedule is.

Any news? Seems like the builder is blowing you off…excuses month after month after month. I’m sure they manage to get subcontractors for other jobs…why not this one? What leverage does the city have to bring them into compliance?

The builder will be getting the sidewalk to where it is passable for citizens to walk on when they get some more favorable weather to do so

The weather has been beautiful, but no progress on fixing this hazard. When can we expect that it’ll be done?

How is it that the developer poured concrete all day yesterday for the house, but has made no progress on the sidewalk? The excuse of not being able to find a subcontractor rings hollow! When will the City require they fix the damage?

Is there any update on when we can expect this to be fixed? There were 15+ more cement mixers on site last week: why can’t the contractor pour the sidewalk and repair the street?

The builder has been put on notice about this and is waiting on a bid for this work to be done with his new contractor, a revision to get the sidewalk around one of the power poles was also holding this work up from being done. The builder did not want heavy truck traffic driving over the new sidewalk and breaking it which i see his point and has been told to get this done sooner than later. As for the road no grinding or overlaying of asphalt can be done between October 1st and March 31st. I will keep you notified once i hear something from the builders rep. Thanks

Any update? Almost two month since the last one. Been torn up almost two years!!!!!

The builder has given a schedule to pour the rest of the sidewalk and mill and overlay the road by June. This will give them time to get deliveries done with heavier trucks so the new sidewalk and curb is not broken by the weight of these vehicles. Thanks

Ok…so it’s now June 20 and no sign of this work beginning…how many times is the City going to allow this developer to break their promises? Is there any consequence?
When will the work be completed and what is the penalty for non performance? How can this issue be escalated?

I sincerely apologize for not getting back to you in a timely manner. I was out of the office for medical leave for almost a month and have been trying to catch up on things. I am currently working with my boss to get this problem solved as the builder is now saying the property has been sold. Moving forward i will keep in touch as soon as i find out the next step to get this resolved. Thank you

*** UPDATE*** The developer was notified again last week informing them they missed the June deadline for this work to be done. We are now going to follow the city municipal code and contact the bond company. This will take some time and everything is a negotiation with them. Additionally, the city will need to go to the small works roster, get quotes from contractors to complete the work, work with the bond company for payment and enter into contract with a contractor. Staff have already started this process. Thanks

Thanks for the update and hope you are feeling better. I appreciate that the City is being more aggressive in dealing with this developer, as they have again and again demonstrated a lack of respect for the codes and for their neighbors.

Public Works understands your frustration with the incomplete work, its appearance on your neighborhood and amount of time needed to get this resolved.

Public Work has reached out to the original developer several times now asking them to complete their work but have only gotten excuses. The developer has been notified the remaining work be completed through the use of their financial guarantee. Please understand, this is a very involved process with a number of requirements the city must follow. The city has already begun the process however it is difficult to estimate how long all this will take. This ticket will remain open so additional information and updates can be posted.

Hopefully this provides you some assurance that you requests have not gone unheard and the city is working to resolve the issues.

That being said, and given that there is active construction underway on both homes in this subplat, is there no other way for the city to apply pressure to persuade the developer to meet their commitments? For example, they have ongoing and frequent need for inspections; seems the city has ample opportunity to provide incentives for them to complete this very basic and uncomplicated part of their project.
In other words, why are they being allowed to continue construction on these two very expensive custom homes while simultaneously blowing off this code violation?

No action so far; now that it’s getting dark earlier this unsafe situation is even more dangerous . How much longer will it take to get this sidewalk and road (which have been torn up by the developer for well over two years!) repaired?

Public Works Development Review understands your frustration and doe not discount your concerns. This matter is being pursued but as explained in the August response this is not a fast process and will take some time to complete. Building permits (for house construction) are not tied to the work out in the street (a right of way permit is required for this work).
