This mountain of snow was pushed there by the business owner and should not be left to the resources of the town to have it removed. It should be up to the business owner to have it removed at his expense. This is a deliberate infraction of the town law and the resources of the town should be spent clearing sidewalks and roadways from normal snowfall and not the deliberate actions of this business.

Not only have they completely block the sidewalk and 3 feet out into main street with snow, they have their sign blocking the sidewalk as well. I hope the taxpayers don't get stuck for helping remove this snow from this private business. The resources could be used for clearing some roads on some streets that are still in pretty tough shape.

Being a member of the Stoneham Chamber of Commerce, this business should have better concern for public safety and respect for stoneham laws.
I see three issues with this violation.
First, this is a violation of town code and the business should be required to rectify it at their own expense.
Second, if the town ends up clearing this obstruction, then the taxpayers are basically paying to clear this business lot. (I would like the town to come down and clear my driveway next snowstorm!)
Thirdly, and this affects everyone in town, the time and resources spent clearing this businesses snow should be spent on other areas of town who are still struggling with narrow streets.

Can I get an update on this situation? Is there any action going to be taken on this hazard? I still have to walk into heavy traffic each morning to get by

Thank you for taking care of this. May I ask you to explain by what by law that sidewalk is not covered by? I assumed all public sidewalks, expescially Main street, we're covered under the by-law prohibiting private citizens or businesses from blocking it with snow. Thank you

Chapter 13 Section 11 (Removal of Snow) does not apply as currently drafted. Chapter 13 Section 12 (Placement of Snow) would apply but is typically done night of / day after snow storm event. Will discuss with Police about potential enforcement.

Sec. 13-12. Same—Deposit of snow on certain sidewalks or streets.
"The tenant, occupant and, in case there shall be no tenant or occupant, the owner of any
building or lot of land bordering any and all public ways, shall not, in the process of snow
removal on the lands owned, occupied, leased or rented by them, deposit snow or cause snow to
be deposited on the sidewalk areas or any other portion of said public ways."

Sec. 13-12 as I read it does not seem to give any
specific time for how long after storm you're not allowed to shovel snow into the street
or a sidewalk. According to your last post, a couple days after a snowstorm I'm allowed to shovel snow from my driveway out into the street as long as I don't do it the day or night right after the storm. Is that correct?

That is not correct.

The problem with this situation is no person was present during the infraction and with the presence of another adjacent business an investigation by the Police will need to be made to confirm the which one is the violator. Issuing an infraction on a business or resident should be based on facts. The Department will work with the Police to find the responsible party.
