In 2019, the 9th Circuit Court of Appeals ruled in Martin vs. City of Boise that criminal sanctions could not be imposed against those sleeping outside on public property when no alternative shelter was available. Recently, the Massachusetts Attorney General cited this case during a decision stating ordinances could not be enacted that prevented people from sleeping on public property. Because of this, Massachusetts municipalities cannot remove encampments unless there is sufficient “alternative shelter” available within the community. There is only one shelter for adult individuals within Brockton at this time, and they do not have the capacity to offer shelter to everyone currently living in encampments.
