Building codes and setback lines should absolutely be enforced. Builder's should comply with local codes. You likely don't care because you don't have to use THAT alley. However, the driveway is IN the alley and an obstruction to cars that have to drive around it. That's why we have local codes and code enforcement. The builder makes a living by complying with the codes. If the codes create some type of problem, then they can apply for a variance.
