The City has determined that it will not enforce against this owner the Ordinance (Sec. 24-17) prohibiting the flow of water across the public way. The City's records indicate this building was constructed without any setback from the public way in the 1930s, long prior to the enactment of the Ordinance. Enforcement of the Ordinance would require significant reconstruction of interior plumbing. ISD will monitor the situation and require prompt maintenance of any ice formation during Winter months.
