DeKalb County just called us back about this issue. Their findings show that this is a private property issue. The HOA for this area would be responsible for clearing out this debris.

The stream is NOT owned by adjacent property owners and it is not the responsibility of adjacent property owners to maintain free flowing conditions of this public drainage way. Rather the stream is under the jurisdiction of the County as a public water/tributary. Debris blocking the stream channel from upstream issues as well as keeping the channel free and clear is the county's responsibility not people who live along the waterway and drainage channel. Please reopen this issue and address the debris so that when the next heavy rain comes folks wont be flooded because the stream channel is blocked!

The issue remains open, however, the City is not liable for this stormwater/drainage issue. It would be the property owners or--in the case that this location turns out not to be--it would be the County's responsibility. Please contact Sandra Brown Hall at DeKalb County Drainage to work out the details at sbhall@dekalbcountyga.gov as she was the one that let us know it would be the property owners responsibility.
