As you were advised last year on this issue as per the City's code of ordinances, maintenance of the swale area is the responsibility of the abutting property owner. Our Engineering department has inspected the area again we provide you with the below observations and recommendations:
1. The entire area along the sidewalk and swale has settle thru the years and the sidewalk is slope the towards the house not the street.
2. It is my recommendation that the sidewalk be removed and replaced and level from the driveway of the house to the south to about 20’ south of the driveway to the house to the north.
3. About 130’ of sidewalk needs to be removed and replaced along the area.
4. New sidewalk will have to be raised about 1’ at the lowest location, existing asphalt driveway will have be made to match the elevation of the new sidewalk. Will probably have to go 4’ into the property and into the driveway approach.
5. A tree removal permit will need to be obtained from Planning and Zoning for the tree located in the swale. Once removed, the swale will need to be re-graded per engineering standards.

@Steve Buckland - In the suggestion to remove/replace the sidewalk in front of our house... to clarify... I thought the City owned the sidewalk, but if the property owners own it, then I understand we should replace it. But, if the city owns the sidewalk, wouldn't they be responsible for replacing it? Also, are there any plans to add culverts to redirect water to the nearby lakes or underground water sources? Thanks.

@Steven Buckand I would like to state we were never advised or did hear back from anyone last year on this situation its unfortunate the only reason why I received a quick reply back this time around is probably because I mentioned getting my attorney involved. I am not sure if I am reading the reponse correctly but are you stating WE are responsible for the sidewalk? My husband was outside that morning when the sub contractor for the city stated that the sidewalk defintley needed to be repaired anything over 4inch of slant would need to be fixed, Now you stated the the homeowners are responsible for the swale but that is not the problem its the City side walk that is causing the flooding issues. Its the lack of maintnance(quick fixes) and drainage over the years that has now caused these sidewalks to pitch inwards causing erosion to the homeowners property driveways (my husband works in this kind of field)and we are responsible for that? If the sidewalks were fixed properly in the first place instead of just sanding down the trip hazards over the years the sidewalks would have never been this bad and now causing flooding and erosion issues. We are not asking to fix our drive way we are asking to fix the City sidewalk so we then can fix our driveway which was most likley damaged due to the lack of maintance to the sidewalk. I would like to know were all our tax money is going which by the way just increased, its not towards the sidewalks tripping hazards or proper drainage the lack of drainage here in this area are becoming health risks from mosquito larva,mosquitos,duck feces and who knows what else. We tried to reach out to the number you had provided to us Mr. Roses but no answer or no call back. I am sure we are not the only homeowners that are going through this as I drive around seeing how most of the sidewalks are becoming a problem or will be soon due to how the problem is being solved. We will be in contact next week to see how we can reolve this issue.
