This case has been closed. Accessory structures may be constructed in accordance with the regulations in Chapter 18 CMC. The City does not enforce HOA rules.
Per International Residential Code (IRC), accessory structures with a floor area of 200 square feet or less do not require a building permit, but are still required to abide by other applicable land use, building, and fire regulations.
Detached residential accessory structures, including tool and storage sheds, gazebos, trellises, play equipment and similar structures, with a floor area not exceeding 200 square feet each may be located in required interior setback areas pursuant to the conditions in CMC 18.30.200 Setbacks – Projections and structures allowed.
